Terms and Conditions
These Terms and Conditions explain the rules for using the Next Level Video website and buying our film and highlight reels. They include our licenses for film, our refund policy and the rules for highlight reels. Please read them before you buy. If you have a question, email us at info@nlvproductions.com.
1. About Us
Welcome to Next Level Video and www.nlvproductions.com (our “Website”). Next Level Video (“NLV”, “us”, “we” or “our”) owns and operates the Website. We are a Pennsylvania limited liability company with headquarters at 1020 Spring Mill Ave, Suite 102, Conshohocken, PA 19428.
Our mission is to provide high quality video footage of athletic events to participating athletes and teams, and to create edited highlight reels for individual athletes. We do this through the services on our Website and the other services we offer (together with our Website, our “Services”).
2. Accepting These Terms
By using our Services, including viewing any part of our Website or buying footage from us, you (“User”, “you” or “your”) agree to be bound by these Terms and Conditions (“Terms”), our Privacy Policy and any other policy we publish from time to time (together, the “Policies”). Together they form a legal and enforceable agreement.
If you do not agree to these Terms and our other Policies, please do not use our Website or our Services.
3. Eligibility and Your Account
You must be at least 18 years old to create an account or buy from us. If the athlete is under 18, a parent or legal guardian must create the account and place the order, and that parent or guardian is responsible for the athlete’s use of the footage and for following these Terms.
- Give us accurate and current information when you create an account or place an order, and keep it up to date.
- You are responsible for keeping your password private and for everything that happens under your account. Tell us right away at info@nlvproductions.com if you think someone else has used your account.
- We may suspend or close an account that breaks these Terms or is used to commit fraud.
4. Using the Website
Your use of our Website and its content is a personal, non-transferable, non-assignable, royalty-free, revocable, limited and temporary license (“License”). The License continues until you stop using the Website or until we end or restrict it in our sole discretion.
You agree not to:
- use the Website for anything unlawful, or in a way that could harm, overload or interfere with it;
- try to get into accounts, systems or data that are not yours, or use bots, scrapers or other automated tools to copy our content or footage;
- copy, sell, rent, publish or share footage or other content in a way these Terms do not allow;
- upload anything that is harmful, offensive or that you do not have the right to share.
5. Orders, Prices and Payment
- All prices are in U.S. dollars. The price shown at checkout, after any coupon or credit, is the price you pay.
- Your purchase agreement becomes effective when you buy film on our Website, by electronic invoice, in person at an event, or by completing an order over the phone with our staff.
- Payments are processed by our payment provider, Stripe. We do not store your full card number on our own systems.
- You are responsible for entering correct athlete, team, grad year and contact information at checkout. We deliver film to the account the order was placed from.
- If we find a pricing or listing error, we may cancel the order and refund what you paid.
6. Film Licenses
Your purchase of video footage is a personal, non-transferable, non-assignable, royalty-free, revocable, limited and temporary license to use our footage under these Terms. The scope of your license depends on the type of package you buy. The footage is our copyrighted property. The license is not a sale or a transfer of ownership.
Single User License
Every package other than a Team Package comes with a Single User License. It is a non-transferable, non-exclusive license to use the footage for your personal, non-commercial use only.
- You can watch full games online through our video player.
- You can download up to twenty (20) clips of up to 45 seconds each from every game you bought, with a total length of all clips not to exceed 10 minutes per game. Downloaded clips are fully editable.
- Downloading a full game file is not available with a Single User License.
- You may not share the footage with any other athlete on your or your child’s team, and you may not use it to make a highlight reel or promotional video for anyone other than yourself or your child (if you are a parent, guardian, relative or friend of the athlete).
- You may not let anyone use the footage for a commercial purpose, public display, sale or rental. No third-party company may edit or reuse the footage in a highlight reel without our written consent.
- You are responsible for everything you upload, post or send with the footage, including content posted through a third party such as a team or business website.
- Making the footage publicly available or downloadable on any video network or file-sharing site (for example YouTube, Vimeo, Hudl, NCSA, Dropbox, Hightail or Google Drive) is unauthorized sharing and breaks this license.
Nothing in these Terms stops you from making your own highlight reel for personal use or from sending your reel to anyone who may want to see it, including college coaches during the recruiting process. You may post or upload footage to a recruiting site only to help the athlete in their recruiting process, and only if the footage is not made publicly available to people who have not bought a license.
Multi-User License
Team Packages come with a Multi-User License. It follows the same terms as the Single User License, except that the footage may be shared with and used by every athlete on the purchasing team. Team Packages are the only packages with a Multi-User License, and the only orders that can download full game files.
7. Filming at Events
We film games and events as part of our Services. By taking part in an event that we film, athletes, coaches, parents and spectators understand that they may appear in our footage. We may use footage and images from events to run, promote and describe our business, subject to any agreement we have with the event organizer.
If you have a concern about appearing in our footage, email us at info@nlvproductions.com and we will review it.
8. Highlight Reels
Highlight reels are an editing service. They are made only from footage that the purchaser owns or is legally licensed to use. By ordering, you promise that you have the right to use any footage you submit to us. Footage shot by NLV is not included with a highlight reel. If you want to use NLV footage, you must first buy it under a Single User or Multi-User License. Any footage mailed to us is non-returnable.
What the purchaser does
- You watch your own footage and send us a time index of each play to use. Our editors do not watch the games and choose plays for you, unless you pay the extra fee for that option, which you can choose at checkout.
- You fill out our online form for the intro slate (usually name, email address, school, graduation year and position). Once the slate is made, changes are free only if we made an error. Special slate requests must be made in writing before production of the slate begins.
- Turnaround time depends on how fast you send everything we need. Once we have it all, we will give you an estimated turnaround.
Standard Highlight Reels
- You may submit up to 15 plays. Plays appear in the order they are listed on your submission form.
- Every play gets a freeze frame and a spot shadow graphic, unless we agreed otherwise. We may skip or double a spot shadow on a play where the editor decides it helps. Tracking and specialty graphics are not included; they cost extra.
- Photos are not used in the intro slate on Standard reels. A photo costs extra.
- After we deliver the reel, any revision request costs extra. We fix our own errors for free.
Premier Highlight Reels
- You may submit up to 20 plays. If you send more than 20, we use only the first 20 listed.
- Every play gets a custom freeze frame and motion-tracking graphics, unless we agreed otherwise. The editor may skip a locator on a play where it is intrusive.
- You may send one action photo for the intro and outro title card. If you do not send one, we make a text-only card. If you send a photo after the card is made, an extra fee applies.
- After we deliver the reel you get one free round of re-arrangements, which means changing the order of the plays you already submitted. Re-arrangement requests must be made within 7 days of receiving the reel. After that, extra editing fees apply.
- Revisions (swapping plays, music changes, text changes, slates) are not re-arrangements and cost extra, unless we made an error. Our errors include misspellings, wrong information, highlighting the wrong player, and highlighting the wrong play.
For all highlight reels
- Finished reels are posted on Vimeo, YouTube or a similar platform and shown on a profile page on our Website. When you approve the final reel, we put a link to download the master file in your dashboard. We do not mail hard copies.
- You can pay us to update a finished reel. The price depends on how much new footage is added. Updates include changing slate information and graphics, adding or removing plays, re-arranging plays and changing music.
- You can have no audio, or a track from our royalty-free music library. We do not use copyrighted music.
- We own the finished reel and may use, post and advertise it without limit and for as long as we like.
- By ordering and submitting a highlight reel, you give NLV and its agents and employees the irrevocable right to reproduce the photographs and video images you submit or we create of the athlete, the purchaser or family members, for publication, promotion, illustration, advertising or trade, in any manner or medium, with or without the athlete’s name. You release NLV and its representatives from all claims about those images and waive any compensation.
- Refunds or credits for highlight reels are decided case by case in our sole discretion, as described in the Refund Policy.
9. Refund Policy
1. General refunds
Event video orders can be refunded for any reason up to seven days before the start of the event. If you ask within seven days of the start of the event, you receive credit toward future NLV event footage instead of a refund. All refund requests must be sent in writing to info@nlvproductions.com. Except as set out below, no refunds or credits are given after the event has started.
2. Quality concerns
Send any quality concern in writing. Name the specific match or matches and give at least two exact time stamps from each match so our staff can review those moments. Reviewing film quality is subjective, so each case is decided individually and at our sole discretion.
- No match is eligible for a refund or credit if 30 days have passed since the event ended, if 30 days have passed since the game film was delivered to you, or if the file has been downloaded in full or as clips.
- Quality concerns must be sent within 72 hours of the first time you watch a delivered game. Viewing and download history is confirmed by our system logs.
- Jersey numbers that are hard to see are not a quality concern. We do not control the size, location or color of numbers on uniforms.
- Footage described as “too zoomed out” is not a quality concern. The film is raw and unedited and can be zoomed in digitally when you make a reel. Wide framing is needed to show player formations. We suggest adding an isolation effect or graphic to identify your athlete.
3. Missed footage
- Matches filmed by a person: plays missed through human error are reviewed case by case, and you must give the exact misses as described above. If most of a match is missed or filmed badly and cannot be fixed, in our sole discretion, we will give a proportionate refund or credit.
- Matches filmed by artificial intelligence: if the camera failed to track the play, there is no refund when we provide a panoramic backup of the match. If the play is in the panorama and can be edited by you, it is considered delivered. If there is no panoramic backup, refunds or credits are at our discretion.
4. Weather
If play at an event is cancelled because of weather, we give credits to customers who bought in advance for matches that never started, if they ask in writing within 7 days of the end of the event. We do not refund or credit matches that are shortened, because we do not control match length. Once a match starts, it is considered played in full.
Events are recorded with limited infrastructure and in the open air. We protect equipment from weather, but things like rain on a lens can happen. There is no refund or credit if the game can still be followed, as decided by us. Send any concern in writing within 7 days of delivery with specific time stamps.
5. Live streams
There is no refund for the quality, connection, drop-outs or a failed signal on live streams for any reason, as long as the match was recorded locally on a camera and we can deliver it within 14 days after the event ends.
6. Medical credits
If illness or injury stops a player who bought film in advance from taking part in the event, we give a credit toward a future NLV event. Send a written request to info@nlvproductions.com within seven days of the end of the event, with a physician’s verification of the injury or illness.
10. Intellectual Property
The Website, our footage, highlight reels, logos, text, graphics, software and other content are owned by NLV or our licensors and are protected by copyright, trademark and other laws. Except for the licenses in these Terms, you get no rights to them.
If you believe content on our Website infringes your copyright, send a notice to info@nlvproductions.com that identifies the work, shows where it appears on the Website and gives your contact details. We will review it promptly.
11. Third-Party Services
Our Services work with services run by others, such as Stripe (payments), Vimeo and YouTube (video), Google (sign-in, reCAPTCHA and analytics) and Facebook (sign-in). Their own terms and privacy policies apply when you use them, and we are not responsible for them.
Our use of information received from Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements. We use that information only to manage the Live Stream section of your YouTube account, and we do not transfer it to other apps or use it for any other purpose. By using NLV you also agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).
12. Assumption of Risk and Disclaimer of Warranties
You use our Services at your own risk and agree to take all necessary precautions.
THE WEBSITE AND OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT FILM WILL RESULT IN A SCHOLARSHIP, ROSTER SPOT OR RECRUITING OUTCOME.
13. Limitation of Liability
(a) We are not liable for any direct, indirect, punitive, special, incidental or consequential damages, losses or expenses arising out of or relating to the use of, or inability to use, our Services. UNDER NO CIRCUMSTANCES WILL OUR TOTAL LIABILITY, IN ANY FORM OF ACTION, IN CONNECTION WITH THESE TERMS OR THE SERVICES EXCEED FIVE HUNDRED DOLLARS ($500.00). You agree that without these limits we could not provide the Services to you, and the limits apply even if they cause your remedies to fail of their essential purpose.
(b) TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, PUNITIVE, GENERAL, SPECIAL, COMPENSATORY OR CONSEQUENTIAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICES, INCLUDING BODILY INJURY, EMOTIONAL DISTRESS, OR ANY DAMAGES RESULTING FROM RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SERVICES OR TRANSMITTED TO OR BY ANY USERS, OR ANY OTHER INTERACTIONS WITH OTHER USERS, ONLINE OR OFFLINE.
(c) Any advice on our Services is for information only and does not replace financial, medical, legal, tax or other professional advice. If you need that kind of advice, please consult a qualified professional.
14. Indemnification
You agree to defend, indemnify and hold harmless NLV and our officers, directors, shareholders, employees, managers, subsidiaries, affiliates, successors, assignees, agents, advisors, representatives, advertisers, marketing partners, licensors, independent contractors, recruiters, corporate partners and resellers (“Affiliates”) from any claims, losses, expenses and demands, including reasonable attorneys’ fees, that a third party brings (including any intellectual property claim) arising out of or relating to (i) material you post through our Services, (ii) your use of the Services, or (iii) your violation of these Terms, our Policies or the law.
You agree to cooperate as reasonably required in defending those claims. We may, at our own expense, take over the defense of any matter that is subject to indemnification, and you will not settle any such matter without our written consent. You also agree to hold us and our Affiliates harmless from any claim arising from a third party’s use of information or materials that you post to our Services.
15. Privacy
Our Privacy Policy explains what information we collect and how we use it. By using our Services you agree to it.
16. Electronic Communications
Visiting our Website, creating an account or emailing us counts as electronic communication. You agree to receive notices, disclosures and other messages from us electronically, by email and on the Website, and you agree that they satisfy any legal requirement that they be in writing. If you place an order by phone with an NLV representative, you agree that they may create an account for you and that you accept these communications.
17. Governing Law and Disputes
These Terms, our Privacy Policy and our other Policies are governed by the laws of the Commonwealth of Pennsylvania and the United States of America, without regard to conflict-of-law rules. Any dispute that cannot be settled informally will be brought in the state or federal courts located in Pennsylvania, and you agree to those courts’ jurisdiction.
18. Changes, Compliance and the Whole Agreement
These Terms and our Policies, together with any document they refer to, are the entire agreement between NLV and you on this subject. We may change these Terms or our Policies at any time in our sole discretion. We will post the latest version on our Website with the date it was last updated, and if you keep using our Services after it is posted, you accept the changes.
You promise to follow all laws, regulations and ordinances that apply to your use of our Website and Services. If any part of these Terms is found invalid or unenforceable, that part is removed and the rest stays in effect.
